Storagians Terms and Conditions
STORAGE:
1.1 The Client:
- Must store Goods in the Storage Space allocated by the Facility Manager ("FM").
- Is deemed to have knowledge of the Goods stored in the Storage Space.
- Warrants that they are the owner of the Goods in the Storage Space and are entitled by law to deal with them in accordance with all aspects of our Agreement.
1.2 The Facility Manager:
- Is a bailee of the Goods (which includes all Goods stored in the Storage Space at any given time).
- Has a general lien over all Goods until the FM receives all payments. If the FM does not receive payment within 90 days after payment is due, the FM may, subject to applicable laws and regulations, sell the Goods by public or private auction and deduct any pending payments.
PAYMENT, COSTS AND EXPENSES:
- The Client must pay storage rent as indicated in the Agreement. Payments must be made on time and in full.
- Late Payment Fees apply as indicated in the Agreement.
- Any Costs or Expenses incurred by the FM in collecting late payments or enforcing the Agreement must be paid by the Client.
- All storage monthly rentals and delivery charges must be paid before the delivery of items.
ACCESS AND CONDITIONS:
- The Client has the right to access their Goods during Access Hours.
- Goods that are dangerous, hazardous, illegal, or perishable cannot be stored.
- Personal valuables such as currency, jewellery, and works of art should not be stored.
- The Client must use the space solely for storage purposes.
RISK AND RESPONSIBILITY:
- No oral statements made by the FM or employees form part of the Agreement.
- The Client must comply with all relevant laws and regulations regarding storage.
TERMINATION:
- Either party may terminate the Agreement after the initial fixed period of storage.
- Upon termination, the Client must remove all Goods and pay any outstanding payments.
DELIVERY OF GOODS:
- Clients must request delivery of Goods via email.
- A minimum of 7 business days advance notice is required for delivery.
- Delivery will be done only once all payments, including delivery and labor charges, are paid in full.
DEFAULT:
- If payments are not made within three months, the FM may sell or dispose of the Goods.
- Any excess funds recovered will be returned to the Client.
NOTICE:
- Notices will be sent via email to the Client. If the Client is unreachable, the Nominee will be notified.
- In case of no response, the Client’s name may be published in a newspaper.
RIGHT TO DISPOSE:
- If the Client’s Goods are not saleable or fail to sell, the FM may dispose of them by any means.
SEVERANCE:
- If any clause of the Agreement is unenforceable, it will be severed or read down.
THIRD PARTIES:
- Only contracting parties have rights under this Agreement.
JURISDICTION:
- The Agreement is governed by the laws of Karnataka, and disputes shall be resolved in Karnataka courts.
